**Self-Build Purchasers and Developers– Important Information**

Where plots are acquired by individual self-build purchasers, the intention of the sale is for the buyer to construct their own home in line with the principles of the Self-build and Custom Housebuilding Act 2015.

Where the land is purchased by a developer, the same Act does not impose direct obligations on the developer in relation to development delivery or plot provision. The statutory duty under the Act rests with the local planning authority, which is required to have regard to demand for self-build and custom housebuilding when planning for housing land supply.

Any requirement for self-build or custom-build plots would only apply where it is specifically secured through planning conditions or a Section 106 agreement attached to the relevant planning permission. This applies equally to small schemes, including sites of two plots. In the absence of such controls, the Act does not restrict a developer or purchaser from acquiring or developing land with planning permission.

**Stamp Duty Savings**
There are notable financial advantages compared to purchasing a fully completed property of similar value. A key benefit relates to Stamp Duty Land Tax (SDLT). In a standard property purchase, SDLT is calculated based on the total market value of the home. However, with a self-build or custom-build project, SDLT is applied only to the value of the plot, not the finished property.
